[ARCHIVED] Officer Justified in Shooting on October 15, 2017

The Burleigh County State’s Attorney’s Office has ruled that Bismarck Police Officer Justin Antonovich was justified in his use of deadly force on October 15, 2017 when he was attacked by 51 year old, Donald Miller, while Officer Antonovich was sitting in his vehicle on an unrelated case at the Bismarck Motor Motel.

In a letter dated December 21, 2017 to Chief Dan Donlin, Burleigh County State’s Attorney Richard Riha stated there was “clear justification for this shooting” and “the officer acted appropriately under the circumstances. Therefore, it is our conclusion that the officer involved shooting of October 15, 2017, at the Bismarck Motor Motel was justified.”

Donald Miller, 51, has been charged with B Felony Robbery and C Felony Simple Assault on a Peace Officer.
